Osaka High Court scraps acquittal
of man charged in fatal beating case

OSAKA -- The high court here has scrapped the acquittal of a man charged with beating a truck driver to death, and ordered a lower court to retry the case.

The Osaka High Court referred the case back to the Kobe District Court, which had acquitted the 20-year-old man, saying that he acted in self-defense.

The man, another 20-year-old man and a 19-year-old boy were charged with beating the 37-year-old victim to death in Amagasaki, Hyogo Prefecture, in July 2005.

The other two were given suspended prison terms. The names of the three are being withheld because they were teenagers at the time of the incident.
